The Violence Against Women Act was signed by President Obama in 2013. 

  1. Does Congress have the power to restore tribes’ inherent authority to exercise criminal jurisdiction over non/Indians? YES. 

2. Concurrent Jurisdiction 25 U.S.C. & 1304(b)(2). So does double jeopardy bar successive tribal/federal prosecution? NO. 

3. Indian Civil Rights Act (ICRA). 

4. SDVCJ (Special Domestic Violence Criminal Jurisdiction). 

5. What rights must be afforded to the Defendants? (All applicable rights under the Indian Civil Rights Act.
